Donna Henderson, the owner of a Douglas area radio station has been named as the defendant in a legal suit filed by Broadcast Music, Inc. (BMI).
According to Arizona Daily, the suit seeks a little over $6,100 and fees.
Copyright laws prohibit the use of music for commercial purposes without a license. Companies such as BMI provide bars, satellite stations, movies and radio stations with the necessary copyright clearance for use of music created by over a million songwriters, composers and publishers.
Douglas Broadcasting purchased a license from BMI in 2012. The license contained a mandatory arbitration clause in the event of a dispute between the parties. Since the forced collection of a monetary arbitration cannot be undertaken, BMI filed a legal suit asking Judge Timothy Dickerson of the Cochise County Superior Court to confirm an arbitrator.
Douglas Broadcasting does business with the radio station, KDAP-FM, a radio station broadcasting country music, along with coverage of local news and community events. Henderson acquired the ownership of Douglas Broadcasting in 2015 following the death of her husband.
