Sen. Gowan bill to use prior DUI as former felony convicted in prosecution signed into law

Senate Bill 1675 sponsored by Arizona State Senator David Gowan, was signed into law on April 1, 2024. 

The bill “allows an aggravated driving under the influence (DUI) offense to be used as a historical prior felony conviction in a prosecution” for a new offense committed by an individual, so long as the DUI was committed within five years of the new offense.

An aggravated DUI is committed when an individual commits a DUI offense with an invalid license, commits a third DUI offense within a total of 84 months, commits a DUI offense with an individual under the age of 15 in the car, commits a DUI offense with an ignition lock device, or commits a DUI offense while driving the wrong way on a highway. 

Gowan represents Arizona as State Senator of District 19, where he is running for re-election in 2024. He also serves as the Chairman of the Senate Appropriations Committee. Gowan has served in the Arizona House since 2009. 

Gowan received his Bachelor's degree from the University of Arizona. Gowan lives in Sierra Vista with his wife Jessie and their two sons.
